Public health forms an integral part in the environment that we live, its main functions is to protect and improve the health of the society through the provision of education and promoting the lifestyles we acquire through research and implementation of the necessary infrastructure to sustain it, this allows the prevention of diseases thus promoting life and improves our health, organized choices are therefore adapted. Gostin explores public health as a big institution. This paper is going to look into the public health core statements developed by Gotsin (2001). By specifically looking at the core functions he addressed.
Functions of Public health law
According to Gotsin (2001) there are five essential characteristics that are fundamental to the demonstration of a clean environment through proper coordination of the different levels involved, this involves legal powers and the duties of the governing body towards ensuring that the conditions of the people living under its jurisdiction are living health. These functions identifies the responsibility of the government, the health status of the entire population, the nature of relationship expected between the government and its population, it also highlights the services available promoting the public health, finally the law regulates on individual businesses for the purpose of protecting the community.
The Responsibility of the government
It usually the responsibility of the government to take responsibility of its population well being, therefore responsible for creating the necessary infrastructure to take care of. This principle helps to explain the duties of the government in matters concerning public health by advocating membership among all the members of the population, stressing shared bondage among its members by putting it to them by offering them with the necessary education so as to safeguard the common health and welfare
Population based perspective
It also focuses on the individuals and persons at stake who ensure the protection and promotion towards a health living, it defines the services provided to the mental and physical health of all the people in the entire community since the sole purpose of public health is to improve the health of its population. It clarifies the kind of relationship that should exist between the individual health and that of the community at large. The focus on the whole population rather than the individuals is aimed at eliminating the underlying causes of the disease, therefore by treating the whole population the disease can be avoided from spreading. Public health can be achieved through a collective responsibility so as to ensure the safety of the people
Relationship between people and the state
The law of public health also clarifies the relationship between the state and the community. According to Gostin (2000) public health laws regulates or has set down laws and procedures to be followed by the public and community at large, a good example is when the government sets standards of the food to be eaten by its population or products of sub standard quality. It further identifies the advantages and setbacks acquired by the government on legally protected interests. This allows for regulation on the government position on major health issues facing the population examples of such include outbreaks, tobacco use, alcohol use, occupational and other risks, the government provides laws, policies and standards
Role of coercion and individual rights
The public law is also concerned with identifying the responsibilities of the government to the population, this allows for the good relationship between the public and the community, it also identifies the range of services offered by the government public health department as a means of promoting the public health and welfare.
